Attorney General William P. Barr has assumed an omnipotent role in deciding that Donald Trump did not obstruct justice.
Today, Barr released his hastily determined summary of the Special Counsel’s investigation into Russian interference in our 2016 presidential election and obstruction of justice. His four-page letter was forwarded to the House and Senate Judiciary Committees, the press and is now in the general public. (A copy is below.)
On the section titled “Obstruction of Justice,” Barr noted that Special Counsel Robert Mueller examined the facts and the law around this issue, and in contrast to “traditional prosecutorial judgment,” chose not to make a decision on this legal question. Legal minds are asking why Mueller refused to fulfill this portion of his responsibility. However what is known from Barr’s short synopsis is that Mueller explicitly stated that he did not exonerate Trump. Nor did he find that he committed the crime of obstruction.
At this point, the Special Counsel’s findings should rightly go to Congress to determine whether a crime was committed through an investigation and then a trial in the Senate, i.e. the impeachment process.
William Barr usurped the role of Congress. He inflated his own responsibility as the nation’s Attorney General. And in basic legal practice, he assumed the role of prosecutor, judge (determining the legal issues) and jury (determining the truth of the evidence). He has by his own hand, knocked over the scales of justice in finding his president innocent of all criminal activity – all within a two-day period.
In this regime, Barr’s actions do not surprise me. But they do leave me with a bleak outlook for our rule of law.
